Nube Immigration

Our Story

Nube Immigration was founded by Rosetta Meschisi and Damaso Hernández, two passionate advocates for immigrant rights who personally understand the legal and emotional challenges that come with the immigration process. Originally from Venezuela, Rosetta and Damaso immigrated to the United States and settled in Madison, Wisconsin, where they experienced firsthand the difficulties and uncertainty of navigating the immigration system. Their own journey as immigrants gave them deep insight into how complex and overwhelming the process can be for those striving to build a new future in this country. Driven by a strong desire to help others overcome these obstacles, they decided to create a service that combines legal expertise with empathy and genuine commitment. That’s how Nube Immigration was born—with the mission of providing individuals and families with the support and guidance they need to pursue their dreams, no matter how complicated the path may seem.

At Nube Immigration, we believe in turning dreams into reality, one step at a time. Named after the Spanish word for “cloud,” Nube symbolizes the limitless possibilities that await those who are willing to take the journey. With a deep commitment to helping clients understand and navigate the complex world of immigration law, we are dedicated to providing personalized legal services that cater to the unique needs of each individual. Whether it’s securing visas, permanent residency, or citizenship, Nube Immigration is here to make every transition smoother and more achievable. Our roots in Madison, Wisconsin, ground us in the belief that everyone deserves a chance at a brighter future, regardless of where they come from.

F.A.Q

We understand that navigating immigration processes can be complex and overwhelming. To help you find the information you need, we’ve compiled a list of frequently asked questions. If you have additional questions, don’t hesitate to reach out to our team!

How do I know which visa is right for me?

The right visa for you depends on your specific situation, including your purpose for staying in the U.S, your qualifications, and your long-term goals.

To request employment authorization in the U.S., you typically need to file Form I-765, Application for Employment Authorization, with U.S. Citizenship and Immigration Services (USCIS).

The timeline for the immigration process varies widely depending on the type of application, visa category, and individual circumstances. Here are some general timeframes:

  • Nonimmigrant Visas (Tourist, Student, Work Visas) – Processing times can range from a few weeks to several months, depending on the visa type and U.S. embassy/consulate workload.
  • Family-Based Green Cards – Spouse, parent, or minor child of a U.S. citizen: 12–24 months. Other family categories: Several years due to visa backlogs.
  • Employment-Based Green Cards – Processing times vary by category, ranging from months to several years.
  • Adjustment of Status (Form I-485) – Typically 8–24 months, depending on USCIS workload.
  • Naturalization (U.S. Citizenship) – Usually 6–12 months after filing Form N-400.
  • Asylum Applications – Decision times vary widely, from months to years.

While legal representation is not required for most immigration applications, having an experienced immigration attorney or paralegal can greatly improve your chances of success.

Whether you can apply for Temporary Protected Status (TPS) depends on your nationality and whether your country is currently designated for TPS by the U.S. government.

For your immigration consultation, bringing the right documents can help the attorney or paralegal assess your case more effectively. Here’s what you should bring:

General Documents (For Any Immigration Case)

  • Identification – Passport, driver’s license, or any government-issued ID.
  • Immigration Documents – Visa, I-94 record, work permits, green card (if applicable).
  • USCIS Notices – Any prior applications, receipts, or decision letters from USCIS.
  • Birth & Marriage Certificates – If applying for a family-based petition or proving relationships.
  • Proof of Residency – Lease agreements, utility bills, or employment records.

Case-Specific Documents

  • For Green Card Applications: Proof of family relationship (marriage certificate, affidavits), sponsor’s financial documents.
  • For Work Visas: Job offer letter, employer sponsorship details, resume, diplomas/certifications.
  • For Asylum or Deportation Cases: Any evidence supporting your claim (police reports, country condition reports, affidavits).
  • For Naturalization: Green card, proof of continuous residence, tax returns, travel history.
  • For TPS or DACA: Proof of continuous presence in the U.S., prior approvals, and renewal notices.

Additional Items

  • Questions List – Write down any concerns or questions you have.
  • Passport Photos – Some applications may require recent photos.
  • Consultation Fee – If applicable, check the cost beforehand.

Getting started with your immigration process is easy! Here’s how you can take the first step:

1. Schedule a Consultation

The best way to get started is by scheduling a consultation with an experienced immigration paralegal or attorney. This initial meeting will help assess your situation, explain your options, and outline the next steps.

2. Prepare Your Documents

Before your consultation, gather all the relevant documents that may apply to your case (such as your passport, visa, birth certificate, previous immigration paperwork, etc.). This will help your consultant understand your case better and give you more accurate advice.

3. Discuss Your Case

During your consultation, be ready to discuss:

  • Your immigration goals (e.g., obtaining a work visa, family reunification, applying for a green card).
  • Any previous immigration history (such as prior visa applications or status changes).
  • Any questions or concerns you may have about the process.

4. Review Your Options

Based on your consultation, the attorney or paralegal will explain your options and recommend the best course of action. They’ll give you a clear idea of timelines, fees, and any additional information they may need to begin working on your case.

5. Begin the Application Process

Once you decide to move forward, your legal professional will guide you through completing and submitting the necessary forms, gathering documents, and filing with USCIS or other relevant agencies.

f your asylum application is denied, it’s important to understand that there are still options available to you. Here are the key steps to take if your asylum case is denied:

1. Appeal the Decision

You may have the option to appeal the denial to the Board of Immigration Appeals (BIA). The appeal must typically be filed within 30 days of receiving the denial notice. The BIA will review your case and determine if the decision should be overturned.

2. Motions to Reopen or Reconsider

If new evidence comes to light or there was an error in how your case was handled, you may file a motion to reopen or reconsider your case. This is typically done within a certain time period after the decision.

3. Seek Alternative Forms of Relief

If your asylum claim is denied, you may still be eligible for other forms of relief, such as:

  • Withholding of Removal – Protects you from being deported to a country where you would face persecution, though it’s a higher standard than asylum.
  • Convention Against Torture (CAT) – If you can prove you would face torture if returned to your home country, you may qualify for protection under CAT.
  • Temporary Protected Status (TPS) – If your country is designated for TPS, you might be eligible for temporary relief.

4. Voluntary Departure

In some cases, you may be allowed to leave the U.S. voluntarily and avoid a formal deportation order. This may allow you to return at a later time if the conditions in your home country change.

5. Seek Legal Counsel

If your asylum case is denied, it’s highly advisable to consult with an immigration attorney or paralegal who specializes in asylum and deportation defense. They can assess your situation, explain your options, and help you navigate the appeals or alternative relief process.

It’s crucial to act quickly if your asylum is denied, as there are strict timelines for appeals and motions. Legal representation can help you explore all available options and improve your chances of a favorable outcome.
